William Baber's Will dated 1792/3
Surveyed 16th April 1783 by Cary Harrison, Assistant for Henry Bell, Surveyor 405 acres in Buckingham County, for WILLIAM BABER on branches of Sharps Creek, beginning at his own pointers and adjoining lands of Peter Fore, Anthony Murray and Robert Cary.
7th May 1796 JOSIAH, ISAAC and ROBERT BABER, Executors of the said WILLIAM BABER requested patent for said land to be issued to Elijah Howell of Buckingham County. Witnesses: Joseph Robertson, Bear Ford, Elijah Ford.
In the name of God Amen: I WILLIAM BABER of Buckingham County, Virginia of sound mind and memory, blessed be to God, do make and constitute this my Will and Testament in manner and form following: First I give and bequeath unto my son GEORGE BABER two work steers and yoke that and no more. Item: I give and bequeath unto my son WILLIAM BABER my wearing clothes and no more. Item: I give and bequeath unto my son JOSIAH BABER two hundred acres of land lying on Sturrup Leather if saved and one negro woman named Nan and one mare named Filly and one feather bed and stead and furniture. Item: I give and bequeath unto my son ROBERT BABER half the land I now live on and for it to be divided in length for ROBERT BABER to have his part on the Creek on which Robert Evans lives on and one horse named Spanker and one negro woman named Sary. Item: I give and bequeath unto ISAAC BABER my son the other part of my land I now live on adjoining ROBERT BABERs part on the Creek I live on and two bulls and Stillard and two smooth guns and one negro man named Seser and one feather bed and stead and furniture and all my working tools to be divided among my three sons, JOSIAH BABER, ROBERT BABER and ISAAC BABER and also for ROBERT BABER to have one feather bed and stead and furniture. Item: I give and bequeath unto my daughter JANE STRANGE one cow and calf. Item: I give and bequeath unto my daughter MARY BABER one cow and calf and ewe lamb. Item: I give and bequeath unto my daughter MILLEY BRAMMER one cow and calf. Item: I give and bequeath unto my daughter LUSEE (Lucy) BABER one mare and colt that she has now in possession and one cow and calf. Item: I give and bequeath unto my daughter DIANA BULLEN (or Ballen) one woman's cloak to be bought out of my estate at forty shillings price. I give and bequeath unto my grandson CALEB BABER five pounds with that shall be a beast purchased by Executors and one saddle that I possessed with now and the rest of my land lying on Sturrup both if saved to be divided between ROBERT BABER and ISAAC BABER and for ISAAC BABER to have his part adjoining to his land and Owls old field and the rest of my personal estate to be divided equally among my three sons JOSIAH BABER, ROBERT BABER and ISAAC BABER and then appoint my three sons Executors of this my last Will and Testament. I desire there may be no appraisement of my estate. I do disanull all other forms of Wills and declare this to be my last Will and Testament this 20th day of March in the year of our Lord Christ One thousand, seven hundred and ninety two. Signed, sealed, published and delivered in the presence of us: Darby Bondurant, David Bondurant, Joseph Bondurant and WILLIAM BABER. Signed with a X.
At a court held for Buckingham County the 9th day of September 1793 this Will was proved by the oaths of Darby Bondurant, David Bondurant and Joseph Bondurant. Witnesses: thereto and sworn to by ROBERT BABER and ISAAC BABER, two of the Executors herein named and ordered to be recorded and on motion of the said Executors who entered into and acknowledged Bond with Security according to Law, Certificate was granted them for obtaining a probate thereof in due form.
